Proposed Air Quality Ordinance Amendments

  Comment Deadline: September 24, 2025

Mecklenburg County Air Quality announces its intent to revise the Mecklenburg County Air Pollution Control Ordinance (MCAPCO).  Notice is hereby given of the opportunity for public comment on incorporation of the proposed revisions into MCAPCO and the Mecklenburg County portion of the North Carolina State Implementation Plan set forth in 40 CFR 52.1770. Persons wishing to submit a comment or request a public hearing about the incorporation of these rules into MCAPCO and the North Carolina State Implementation Plan are invited to do so using any of the six methods listed below.  The thirty (30) day public comment period begins on August 25, 2025, and all comments must be received by MCAQ no later than September 24, 2025.  

 

The proposed revisions are necessary to meet North Carolina and United States Environmental Protection Agency (USEPA) requirements, and have been provided to the County Attorney, the North Carolina Division of Air Quality, and USEPA, Region IV for their review.  The proposed revisions will contain State rules adopted by reference and an administrative update to permitting and compliance fee amounts to incorporate an annual consumer price index adjustment that became effective July 1, 2025. The Mecklenburg County Air Pollution Control Ordinance (MCAPCO) provides for the administration and enforcement of an air pollution control program for the protection of the environment and protection of the public health and applies throughout Mecklenburg County, North Carolina, including but not limited to all cities, towns, hamlets, and villages whether incorporated or unincorporated.

Proposed Air Quality Permits

MCAQ values community input during the permitting process. The public is invited to review and provide comment on the draft air quality permits below.  Each draft permit has undergone a thorough review (see the Application Review Summary) and incorporates the necessary pollution controls, monitoring, testing, record keeping and reporting requirements to ensure ongoing compliance.  

Comments that accurately and specifically address a concern about the draft permit are most effective. Public comments can impact permit conditions, making for a more comprehensive and complete compliance document. 

Mecklenburg County Air Quality will consider all comments received on or before the Public Comment Deadline.
