Asbestos NESHAP Program and Regulations

Demolition and asbestos removal activities are subject to the National Emission Standards for Hazardous Air Pollutants for Asbestos, commonly referred to as the Asbestos NESHAP.  Read Mecklenburg County Air Quality's (MCAQ) Asbestos NESHAP Program Brochure to learn more about the local program.

The term facility, as defined in the asbestos NESHAP, does not include residential buildings having four or fewer dwelling units.  Not sure if your residential project is subject?  Complete a Residential NESHAP Applicability Form (PDF or Word) and submit to MCAQ.

When To Submit A NESHAP Notification Form

Submittal of a NESHAP notification form to Mecklenburg County Air Quality (MCAQ) is required 10 working days prior to starting date for demolition or renovation whenever a facility (i.e. industrial, commercial, business, school, or church buildings, and even private residences in certain circumstances) is scheduled to either:

  • undergo extensive renovation entailing the disturbance of regulated quantities of identified ACM (i.e. quantities equaling or exceeding 260 linear feet/160 square feet/35 cubic feet), or

  • undergo partial/complete demolition of the facility including move-off or intentional burn.  **Notification for demolition must be submitted with an Asbestos Inspection Report**

 

NESHAP Fees

For renovation (asbestos removal) NESHAP notifications only, the fee is $365 (Revised July 7, 2016).  Payment shall be paid either online or by check made payable to Mecklenburg County Air Quality and submitted to MCAQ with the notification.  If paying online, include the name and address of the building to be renovated in the comments section.

Demolition permits are obtained by the property owner or owner's agent from the Land Use and Environmental Services Agency, Code Enforcement Division.  All fees for demolitions are paid to Code Enforcement when the demolition permit is issued. For Demolition and Move-Off permit information, please visit Mecklenburg County Code Enforcement’s permitting page.

Individuals performing asbestos management activities as defined by 10A NCAC 41C.0600, except as provided for in G.S. 130-447, (b) and (c), must be accredited by the NC Asbestos Hazard Management Program, Health Hazards Control Unit (HHCU).  State issued permits are required for removal of regulated asbestos containing material that exceeds 160 square feet, 260 linear feet, or 35 cubic feet.
